1. Agreement to Our Terms

By utilizing the Mantis Tree Care website or engaging our services for any arboricultural or land-management project, you (“Client,” “you,” or “your”) agree to abide by these Terms of Service (“Terms”). If you do not consent to any aspect of these Terms, you should not proceed with utilizing our site or scheduling our services.

These Terms govern the relationship between Mantis Tree Care, a family-owned and operated company serving the Vero Beach community (“Mantis,” “we,” “us,” or “our”), and all Clients, site visitors, and individuals who interact with our business.


2. Scope of Services & Expertise

Mantis Tree Care offers comprehensive, professional arboriculture services backed by over 25 years of combined, hands-on experience in the Indian River and St. Lucie County area.

Our core services include:

  • Safe removal of trees of all sizes (hazardous, dead, or unwanted)

  • Specialized palm tree pruning and cleaning

  • General tree trimming and canopy shaping

  • Stump grinding and debris removal

  • Land clearing and lot preparation

  • Cabling and bracing for structural support

  • Emergency storm response and cleanup

  • Pet and drone rescue from trees

All operations are executed by our skilled team, adhering to strict safety protocols. We are a fully Licensed and Insured company, carrying comprehensive liability coverage for your complete protection.


3. Pricing, Authorization & Payment

3.1 Estimates and Site Conditions

We provide initial estimates after an in-person or virtual evaluation of the job site. Please note that an estimate is a preliminary assessment, not a fixed contractual price. The final cost may need adjustment if unexpected site issues, hidden tree defects, or discrepancies from the initial description are encountered.

3.2 Formal Quotes and Work Scheduling

Work will be formally scheduled only after you receive and approve a written quote outlining the exact scope of work, the final price, and payment conditions. Your approval serves as authorization for Mantis to begin the contracted work.

3.3 Payments and Deposits

Final payment is due immediately upon the satisfactory completion of the contracted services, unless alternative arrangements are documented in the quote. For larger projects or specialty services, an upfront deposit may be required to cover mobilization or equipment rental costs.


4. Client Responsibilities and Site Access

As the Client, you are responsible for ensuring a clear and safe working environment. You agree to:

  • Provide unimpeded access for our crew and heavy equipment to the designated work zone.

  • Relocate all personal property, including vehicles, outdoor furniture, and ornaments, from the path of operations.

  • Ensure all pets and children are secured away from the work area for the duration of the job.

  • Clearly identify and mark all underground utilities, septic systems, irrigation lines, or buried cables on your property prior to our arrival, unless we specifically agree in writing to handle utility location.

Mantis Tree Care is not liable for any damage caused to unmarked subterranean utilities, hidden structures, or unknown obstacles that were not disclosed or could not be reasonably detected by our team.


5. Safety Protocols and Service Limits

Arboriculture inherently involves complex risks. To protect our crew and your property:

  • Work Stoppage: We reserve the right to temporarily pause or reschedule work due to safety concerns, including severe Florida weather (heavy rain, wind, lightning), equipment malfunction, or unstable ground conditions.

  • Exclusion Zone: You, your family, or your guests may not enter the active work zone at any time while our crew is operating.

  • Customer-Created Hazards: If conditions are rendered unsafe by a Client’s failure to follow safety instructions or clear the site, we may halt the job, and the Client may be subject to additional fees for rescheduling or costs already incurred.


6. Emergency Services and Pricing

We provide 24-hour emergency tree response to assist with limbs, fallen trees, or storm damage that poses an immediate risk to people or property. Due to the urgency, resource mobilization, and often hazardous nature of this work, the pricing for emergency services will generally be higher than standard rates. Emergency work may involve temporary stabilization or partial removal before full restoration can be safely carried out.


7. Site Cleanup and Debris Handling

The scope of debris removal and site cleanup is strictly defined in your written quote. If cleanup is included, it covers the removal of materials directly generated by the agreed-upon work. Any request for cleanup, chipping, or hauling of pre-existing yard waste, or debris outside the initial scope, will result in a separate, additional charge.


8. Licensing, Insurance & Certifications

Mantis Tree Care is a Fully Licensed and Insured service provider, operating in accordance with all relevant county and state regulations for arboricultural work in Florida.

  • Insurance: We maintain comprehensive liability insurance. Proof of current insurance coverage is available upon request.

  • Experience: Our crew operates with the benefit of over 25 years of combined experience in the field.


9. Website and Content Usage

9.1 Intellectual Property Rights

All written content, images, company logos, service descriptions, and media displayed on the Mantis Tree Care website are the exclusive property of Mantis Tree Care or its licensors. Unauthorized copying, distribution, or reproduction of any content is strictly prohibited without our prior written consent.

9.2 Acceptable Use

You agree not to disrupt the functionality of the website, attempt unauthorized access, or use the website for any harmful, illegal, or malicious purposes.


10. Data Protection and Communication

We respect your privacy. We collect data for the sole purpose of service delivery and business optimization.

  • Information Collected: We collect contact details (name, address, phone, email) submitted via contact forms to facilitate service requests and estimates. We also collect non-identifying technical data (e.g., website traffic analytics) to improve our online experience.

  • Data Usage: Your submitted information is used exclusively to respond to your inquiries, schedule services, and provide quotes. We do not sell, rent, or share your personal contact information with third parties for marketing purposes.


11. Rescheduling and Project Termination

11.1 Client Rescheduling or Cancellation

If you need to reschedule or terminate a confirmed job, you must notify us immediately. If cancellation occurs after we have incurred costs (e.g., permits, special equipment rental, mobilization), a cancellation fee may be applied to cover those non-recoverable expenses.

11.2 Company Rescheduling or Cancellation

We may initiate a reschedule or cancellation due to factors outside our control, including:

  • Unsafe weather or severe storm activity.

  • Equipment breakdown.

  • Discovery of unexpected hazards or misrepresentation of job details by the Client.

We commit to communicating promptly and finding a new agreeable date for service completion.


12. Limits of Liability

To the maximum extent permissible by Florida law:

  • Scope Limitation: Our total liability for any claim arising from the services is strictly limited to the total amount paid by you for the specific project in question.

  • Exclusions: We shall not be held liable for indirect or consequential damages (such as profit loss or financial delays).

  • Non-Liability: We are not responsible for damages resulting from:

    • Failure to mark underground utilities (as noted in Section 4).

    • Pre-existing, hidden tree defects (e.g., internal decay, weak unions, or unseen root rot).

    • Damage to trees or property caused by natural weather events (storms, lightning) before or after the contracted work is completed.

Note: The condition of live trees is dynamic. While we strive to promote health, we offer no long-term warranty or guarantee regarding the future stability or health of trees we have pruned or assessed.


13. Governing Law and Dispute Resolution

These Terms and any related services provided by Mantis Tree Care are governed by and interpreted in accordance with the laws of the State of Florida.

Any disputes will first be addressed through good-faith discussion between the Client and Mantis Tree Care. Should a resolution not be found, legal proceedings may be conducted in a court of competent jurisdiction within Indian River County, Florida.


14. Amendments to these Terms

We may revise these Terms periodically. The current, effective version will always be posted on our website. Your continued use of our website or services following any updates signifies your acceptance of the revised Terms.
